Welcome to Black Diamond Athletics ("BDA," "we," "us," or "our").
These Terms & Conditions govern your use of the Black Diamond Athletics website and your participation in our programs, classes, teams, camps, clinics, events, and related services.
By using our website, submitting an inquiry, registering for a program, or participating in a BDA program, you agree to these Terms & Conditions.
If you are registering a minor, you represent that you are the child's parent or legal guardian or otherwise have legal authority to register the participant.
1. Our Programs
Black Diamond Athletics provides youth athletic and recreational programs, which may include:

All-Star Cheer

Tumbling
-
STUNT
-
Non-competitive cheer
-
Preschool programs
-
Camps
-
Clinics
-
Private lessons
-
Events
-
Competitions
-
Other athletic and educational activities
Programs, schedules, pricing, coaches, locations, and availability may change.
2. Registration
Registration information must be accurate and complete.
Parents or legal guardians are responsible for providing accurate information regarding the participant, including age, emergency contacts, medical considerations, and other information reasonably necessary for safe participation.
Submitting an inquiry or interest form does not guarantee enrollment or placement in a program.
Enrollment is subject to availability and any applicable program requirements.
3. Payments and Fees
Program fees, tuition, registration fees, competition fees, uniforms, apparel, camps, clinics, and other charges are disclosed during the applicable registration or purchasing process.
By registering for a paid program, you agree to pay the applicable fees according to the payment schedule provided by BDA.
Failure to make required payments may result in suspension or cancellation of participation.
Additional program-specific cancellation, refund, or payment policies may apply and will be provided during registration when applicable.
4. Program Changes
BDA reserves the right to modify schedules, instructors, class locations, program offerings, team assignments, or other program details when reasonably necessary.
We will make reasonable efforts to communicate significant changes to families.
5. Athlete Conduct
Participants are expected to:

Treat coaches, staff, teammates, competitors, and other individuals respectfully

Follow coach and staff instructions
-
Follow facility rules
-
Use equipment appropriately
-
Maintain appropriate behavior
-
Avoid bullying, harassment, intimidation, or abusive conduct

Respect the safety of others
BDA may take appropriate action when a participant's behavior creates a safety concern or significantly disrupts the program.
Depending on the circumstances, consequences may include a warning, removal from a class or activity, suspension, or dismissal from a program.
6. Parent and Guardian Responsibilities
Parents and guardians are responsible for:

Providing accurate registration information

Keeping emergency contact information current

Communicating relevant information regarding the participant
-
Ensuring the participant arrives on time

Picking up the participant promptly when required
-
Reviewing program rules and communications
-
Paying applicable fees
-
Following BDA policies
7. Assumption of Risk
Participation in cheerleading, tumbling, STUNT, athletic training, preschool activities, and related activities involves inherent risks.
These risks may include, but are not limited to:

Falls
-
Sprains
-
Strains
-
Bruises
-
Fractures
-
Head injuries
-
Concussions
-
Muscle injuries
-
Joint injuries
-
Back or neck injuries
-
Accidental contact with other participants
-
Equipment-related injuries
-
Injuries resulting from physical exertion or athletic activity
Participants and their parents or guardians understand that athletic activity carries inherent risks, even when appropriate instruction, supervision, and safety procedures are used.
Participation is voluntary.
These Terms & Conditions do not replace or eliminate any separate liability waiver, assumption-of-risk agreement, medical release, or other document that BDA requires parents or guardians to sign.
8. Medical Information and Emergencies
Parents or guardians are responsible for providing BDA with accurate and relevant emergency and medical information.
In an emergency, parents or guardians authorize BDA personnel to seek appropriate emergency medical assistance for a participant when reasonably necessary.
Parents or guardians remain responsible for applicable medical expenses and should maintain appropriate health insurance coverage.

BDA may communicate with families through:

Other communication methods provided by the customer
By providing contact information, you agree that BDA may use that information for communications related to services you request or participate in.
Marketing communications require appropriate consent where required by law.
10. SMS/Text Messaging Terms
If you separately opt in to receive text messages from Black Diamond Athletics:

Message frequency may vary.

Message and data rates may apply.

You may reply STOP to opt out at any time.

You may reply HELP for assistance.

Consent is not a condition of purchasing goods or services.

Your consent applies to communications from Black Diamond Athletics and is not transferable to another company.
BDA's SMS program may include messages regarding program inquiries, registration information, class reminders, schedule information, events, promotions, and other communications consistent with the program to which you consented.
Carriers are not responsible for delayed or undelivered messages.
HighLevel's current requirements call for business identification, message-frequency disclosure, message/data-rate disclosure, HELP instructions, STOP instructions, and accessible Privacy Policy and Terms links in the consent flow.
11. Email Marketing
If you opt in to receive marketing emails, you may unsubscribe at any time using the unsubscribe link provided in the email.
Unsubscribing from marketing communications does not necessarily stop service-related communications that are necessary to administer your registration or participation.
12. Website Use
You agree not to:

13. Intellectual Property
Unless otherwise indicated, content appearing on the BDA website—including logos, branding, photographs, graphics, text, videos, designs, and other materials—is owned by or licensed to Black Diamond Athletics.
You may not reproduce, modify, distribute, sell, or commercially exploit BDA content without written permission.
14. Photos, Videos, and Promotional Materials
BDA may photograph or record activities at its facility, events, competitions, camps, and programs.
Any use of an athlete's image or likeness for promotional purposes should be governed by the applicable photo/video release or consent provided by the parent or legal guardian.
15. Third-Party Services
BDA may use third-party services for website hosting, registration, scheduling, payments, communications, marketing, analytics, and other business functions.
Those services may have their own terms and privacy policies.
BDA is not responsible for the policies, security, availability, or performance of third-party services outside our control.
16. Website Information
We make reasonable efforts to keep website information accurate and current. However, errors, omissions, outdated information, or technical problems may occasionally occur.
BDA reserves the right to correct errors and update website content without notice.
17. No Guarantee of Results
Participation in BDA programs does not guarantee a particular athletic skill level, competition result, team placement, award, scholarship, or other outcome.
Athletic development varies from participant to participant.
18. Suspension or Termination
BDA reserves the right to suspend or terminate participation when reasonably necessary, including for:

Nonpayment

Repeated violations of BDA rules

Unsafe conduct
-
Harassment or bullying
-
Disruptive behavior
-
Providing false information
-
Conduct that creates a safety concern

Other significant violations of BDA policies
19. Privacy
Your use of the BDA website and services is also governed by our Privacy Policy, which explains how we collect and use personal information.
Our Privacy Policy is incorporated into these Terms & Conditions by reference.
20. Changes to These Terms
We may update these Terms & Conditions periodically.
Updated Terms will be posted on this website with a revised Effective Date.
Your continued use of the website or participation in BDA programs after changes are posted constitutes acceptance of the updated Terms, to the extent permitted by law.
21. Governing Law
These Terms & Conditions are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
Any dispute will be handled in accordance with applicable Utah law and any applicable agreement or waiver signed during registration.
